2) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and can enter into a binding contract in your jurisdiction.
3) The Service
Moodra is your personal mood tracker and calendar for recording daily emotions in seconds and seeing how they change over time. We may add, modify, or remove features at any time.
4) Accounts
- Account info: you may be asked to provide your name, username, and email address.
- Security: you are responsible for your credentials and activity under your account.
- Suspension/termination: we may suspend or terminate access for violations, harm, or legal compliance.
5) Your content and user inputs
The Service may allow you to submit text, images, mood entries, and support messages (“User Content”). You retain ownership of your User Content.
- License to operate: you grant us a limited license to host, store, reproduce, and process your User Content solely to operate, provide, maintain, and improve the Service and to fulfill your requests.
- Photos and biometrics: we do not perform face recognition and do not collect biometric identifiers.
- Your responsibility: you are responsible for your User Content and confirm you have rights to submit it.
6) Acceptable use
- Do not use the Service unlawfully, harmfully, or fraudulently.
- Do not attempt unauthorized access or disrupt the Service.
- Do not introduce malware or interfere with security.
- Do not reverse engineer except where prohibited by law.
- Do not infringe others’ intellectual property or privacy rights.
7) Privacy
Your use of the Service is subject to our Privacy Policy, which may be provided separately within the App or on a website.
8) Third-party services
The Service may rely on third-party tools or infrastructure (for example, hosting, analytics, or crash reporting). Those services are governed by their own terms and policies.
9) Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
Moodra does not provide medical, psychological, or clinical advice. The Service is for informational and personal tracking purposes only. If you have concerns about your health or safety, seek professional help or emergency assistance.
10) Limitation of liability
To the maximum extent permitted by law, Moodra will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service.
To the maximum extent permitted by law, Moodra’s total liability for all claims will not exceed the amount you paid to Moodra for the Service in the 12 months before the event giving rise to the claim (or, if you paid nothing, USD $10).
11) Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Moodra from claims arising out of your User Content, misuse of the Service, or violation of these Terms.
12) Changes to the Service or Terms
We may update the Service and these Terms from time to time. We will post the updated Terms with a new Effective Date. Continued use after an update means you accept the updated Terms to the extent permitted by law.
13) Governing law and dispute resolution (binding arbitration)
- Governing law: the laws of the jurisdiction where Moodra Team is principally located (without regard to conflict-of-laws principles).
- Informal resolution first: contact us at qmvardhdbv1171@outlook.com.
- Binding arbitration: unresolved disputes will be finally resolved by binding arbitration, on an individual basis, in Moodra Team’s principal place of business, under the arbitration rules then in effect there.
- No class actions: disputes will be brought only in an individual capacity to the maximum extent permitted by law.
14) Miscellaneous
- Entire agreement: these Terms are the entire agreement regarding the Service.
- Severability: if any provision is unenforceable, the rest remain effective.
- No waiver: failure to enforce is not a waiver.
- Assignment: you may not assign these Terms without consent; we may assign in connection with a business transfer.
